Terms of Use

These Terms of Use ("Terms") govern your access to and use of Tellyng, a web application operated by Championized LLC ("Championized," "Tellyng," "we," "us," or "our"). By accessing or using Tellyng, creating an account, or purchasing access, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use Tellyng.

1. What Tellyng Provides

Tellyng provides AI-guided tools that help users develop memories, notes, drafts, photographs, and personal experiences into written stories. Tellyng may ask follow-up questions, suggest structure, and generate or develop prose based on material supplied by the user.

Tellyng is a writing-assistance service. It is not a professional ghostwriting engagement, publishing service, archival guarantee, legal service, therapy service, or substitute for professional advice.

2. Eligibility and Accounts

You must be at least 18 years old or have the permission and involvement of a parent or legal guardian to use Tellyng. You must provide accurate account information and keep your login credentials secure. You are responsible for activity conducted through your account.

Notify us promptly at support@tellyng.com if you suspect unauthorized access.

3. Free Trial

Tellyng may offer a limited free experience without requiring an account or payment card. The availability, features, and limits of a free trial may change. Creating multiple identities or using automated methods to evade trial limits is prohibited.

Content entered during the trial may be processed by our AI and infrastructure providers to generate the requested result. A free trial does not guarantee permanent storage of the content or generated result. Users should save any result they wish to keep.

4. Paid Access and the Six-Month Term

Unless otherwise stated at checkout, a purchase provides one user with six months of paid Tellyng access beginning on the date of purchase.

This is a fixed-term, one-time access purchase. It does not automatically renew unless automatic renewal is clearly disclosed and separately authorized at checkout.

During the paid-access period, the user may access the features included in the purchased plan, subject to reasonable usage limits, technical availability, and these Terms.

Each paid purchase includes up to 60 AI-guided story-development sessions during the six-month access period. A session is counted when a user starts an AI-guided session and Tellyng generates the first AI response for that session. A session may include multiple follow-up questions and responses within the same guided interaction. Unused sessions expire at the end of the six-month access period, do not carry over, and have no cash or refund value. Reaching the 60-session limit ends access to additional AI-guided sessions for that access period, although the user may continue to review and export available content.

When the six-month period ends:

• The account and existing projects become read-only.
• The user may review and export available content.
• The user may not create new projects or use AI-assisted development features unless access is renewed.
• Existing content remains subject to our Privacy Policy and retention practices.

We may change future prices, features, or renewal options, but changes will not shorten a paid access period already purchased.

5. Refund Policy

Because Tellyng incurs costs when AI processing begins, purchases are nonrefundable after AI use begins.

For purposes of this Policy, AI use begins when you submit content or instructions for processing through an AI-assisted paid feature.

If you purchased access but have not used an AI-assisted paid feature, you may request a refund by emailing support@tellyng.com. Any approved refund will be returned through the original payment method. This Policy does not limit any non-waivable refund or cancellation rights provided by applicable law.

In plain terms: not sure yet? Try the free session first. If you pay and haven't used any AI sessions yet, email us for a full refund.

6. Your Content and Ownership

As between you and Championized LLC, you retain ownership of the original content you submit to Tellyng, including your memories, notes, drafts, manuscripts, photographs, and other materials.

You grant Championized LLC a limited, nonexclusive, worldwide license to host, store, reproduce, transmit, format, and process your content only as reasonably necessary to operate, secure, support, and improve Tellyng and provide the features you request. This license ends when your content is deleted from our active systems, except for limited backup retention, legal obligations, dispute resolution, and deidentified information.

You represent that you have the necessary rights and permissions to upload and process the content you submit. Do not upload material that unlawfully violates another person's copyright, privacy, publicity, confidentiality, or other rights.

7. AI-Generated and AI-Assisted Content

AI systems can produce inaccurate, incomplete, repetitive, inappropriate, or fabricated information. You are responsible for reviewing, editing, fact-checking, and deciding whether to use or publish any output.

Tellyng is designed to develop material supplied by the user, but we do not guarantee that output will perfectly reproduce your voice, preserve every fact, or be free from similarities to other material.

You are responsible for the final content you save, export, share, or publish. Do not rely on Tellyng for medical, legal, financial, mental-health, emergency, or other professional advice.

8. Acceptable Use

You may not use Tellyng to:

• Violate any law or another person's rights.
• Upload content you do not have the right to use.
• Harass, threaten, exploit, defame, impersonate, or invade the privacy of another person.
• Create or distribute malicious code, spam, fraud, deceptive content, or unlawful material.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Circumvent access restrictions, usage limits, payment requirements, or security controls.
• Scrape, reverse engineer, probe, disrupt, or overload the service except where such restriction is prohibited by law.
• Use automated systems to create accounts or abuse free trials.
• Use Tellyng in a way that violates the usage policies of Anthropic, Emergent, or another applicable service provider.

We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect the service, our users, or others.

9. Copyright Concerns

If you believe content processed or made available through Tellyng infringes your copyright, email support@tellyng.com with enough information for us to identify the work, the allegedly infringing material, your contact information, and a statement explaining your good-faith belief that the use is unauthorized.

10. Service Availability and Changes

We may update, modify, suspend, or discontinue features to maintain security, comply with law, improve the service, or address technical and business needs. We do not guarantee uninterrupted or error-free operation.

We will not intentionally remove paid access without cause during an active term. However, temporary outages, maintenance, third-party failures, safety restrictions, and circumstances beyond our reasonable control may affect availability.

You are responsible for maintaining your own copies of important exported content. Tellyng should not be treated as the sole permanent archive of irreplaceable material.

11. Suspension and Termination

You may stop using Tellyng at any time. You may request account deletion by contacting support@tellyng.com.

We may suspend or terminate access if you materially violate these Terms, create security or legal risk, fail to pay amounts due, misuse the service, or use Tellyng in a way that could harm others or the service. When reasonably appropriate, we may provide notice and an opportunity to correct the violation.

Termination does not eliminate payment obligations already incurred or provisions that by their nature should survive, including ownership, disclaimers, limitations of liability, and dispute provisions.

12. Third-Party Services

Tellyng relies on third-party services, including Emergent (hosting, database, object storage, Google sign-in, and AI integration), Anthropic (Claude), Stripe (payments), and analytics and communications providers. Your use of certain features may also be subject to those providers' terms and policies. We are not responsible for third-party services outside our reasonable control.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELLYNG IS PROVIDED "AS IS" AND "AS AVAILABLE." CHAMPIONIZED LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND THAT THE SERVICE WILL BE ERROR-FREE OR MEET EVERY USER'S EXPECTATIONS.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMPIONIZED LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO TELLYNG.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CHAMPIONIZED LLC FOR CLAIMS ARISING FROM OR RELATED TO TELLYNG WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TELLYNG DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.

These limitations do not apply where prohibited by law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Championized LLC and its owners, officers, employees, and contractors from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of Tellyng, your content, your violation of these Terms, or your violation of another person's rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction located in Cook County, Illinois, unless applicable consumer law requires otherwise.

Before filing a claim, you agree to contact us at support@tellyng.com and attempt to resolve the dispute informally. Nothing in these Terms prevents either party from seeking relief in small-claims court when eligible or from seeking emergency injunctive relief.

17. Changes to These Terms

We may update these Terms as Tellyng evolves. The revised Terms will be posted with a new effective date. If changes materially affect an existing paid-access period, we will provide notice when required by law. Continued use after revised Terms take effect constitutes acceptance of the revised Terms.

18. General Terms

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without our permission. We may transfer these Terms as part of a reorganization, financing, merger, acquisition, or sale of the business.

These Terms, together with the Privacy Policy and any purchase disclosures, constitute the agreement between you and Championized LLC concerning Tellyng.
